Key Updates on the Restoration of the Reservation Process in Ukraine: CMU Resolution No. 1332

The Cabinet of Ministers of Ukraine (CMU) has finally published Resolution No. 1332 dated November 22, 2024, which reinstates the reservation process starting from December 1, 2024.

Key Points of the Resolution:

1. Current reservations issued in paper format based on orders from the Ministry of Economy or through the Diia electronic portal will remain valid until their expiration but no later than February 28, 2025.
2. From now on, reservations of conscripts will only be processed via Diia, with a decision timeframe of 72 hours.
3. Reservations through Diia will be processed automatically if the following conditions are simultaneously met:
• The conscript is registered for military service.
• The conscript is employed by a critically important enterprise.
• The conscript holds a position at a critically important enterprise or institution and has received a salary for each month of the last reporting period (quarter) that is at least 2.5 times the national minimum wage (currently, this equals UAH 20,000).
• The conscript is not under search.

All this information is sourced from relevant registers. However, it remains unclear whether it will suffice to pay the required salary in the last month prior to the application date for reservation or if a full reporting quarter will be required (this could be critical for new employees of the company). We are currently awaiting clarification from representatives of the Ministry of Digital Transformation.

4. Among the criteria for a critically important enterprise, the average salary of employees has been increased to at least 2.5 times the national minimum wage (UAH 20,000).
5. Female conscripts are no longer included in the quota for reservable conscripts.
6. Conscripts with any Military Occupational Specialty (MOS) can now be reserved.
7. Cancellations can be processed via Diia.
8. The criticality of an enterprise will now be approved by the Ministry of Economy and the Ministry of Defence.

Other conditions remain largely unchanged.
